Municipal Administrative Speeding Penalty (GAS5)
In virtue of the above police regulation and article 29 quater of the Road Traffic Act, administrative fines can be imposed for minor speeding offences provided the following conditions are met cumulatively:
- the speeding offence was committed at a location where a speed limit of 30 to 50 kilometres per hour applies;
- the maximum speed limit was exceeded by no more than 20 kilometres per hour (following adjustment by the technical tolerance margin);
- the speeding offence was established in accordance with the conditions set out in article 62 of the Act of 16 March 1968 on Roads Policing, with the exception of the sixth and eighth paragraphs, with automatic devices, fully funded by the local administration;
- the speeding offence was committed by an adult natural person or by a legal person;
- other than the speeding offence, the offender was not found to have committed any other offence.
